Before paying for a famous foreign surgeon in China, check the licence, not the brochure

A foreign doctor may operate in China only with a short-term practice permit issued by the city health authority and tied to one named hospital. Without it, the surgical records can be void and an insurer can refuse the whole claim. Four checks, made before you pay, protect the family.

Some intermediaries sell "a top overseas surgeon, personally operating". Under the foreign doctors' short-term practice measures, any direct clinical work by a foreign doctor in China, including diagnosis, prescribing and surgery, needs an administrative permit. Invitations from academic bodies, commercial contracts or a department head's private agreement do not replace it. Practising without it is treated as unlicensed practice.

What the permit is

  • Issued by the health authority of the city (prefecture-level) where the inviting hospital sits, after review of qualifications, home licence, clean record and health certificate. Beijing's 2026 guide, as our source reports it, sets a 30-working-day statutory limit and an 8-day service pledge.
  • Valid for at most one year, with no automatic renewal.
  • Tied to the named hospital. A tour of several hospitals needs separate approvals.
  • Hong Kong and Macau doctors (up to three years) and Taiwan doctors fall under separate rules.

The usual workarounds

Three recur. "Academic exchange" visas used for a "demonstration" operation, though conferences and teaching rounds stop short of touching patients. A visiting "consultation expert" who simply walks into theatre. And "ghost surgeon" records, in which the foreigner operates but the chart names a Chinese colleague, which erases the true surgeon from the record.

Why it matters financially

Records signed by an unlicensed doctor lose their evidential force, and the inviting hospital carries the civil liability. Insurers also read the operative notes: if the lead surgeon had no permit, a complication such as a leak, infection or nerve injury can lead to a refusal of the entire stay under illegal-act exclusions. The surgeon will be back home; the family is left with the bill.

Four checks before you pay or sign

  • Ask the hospital's Medical Affairs Office for the original permit, not the agent's copy. Check the name against the passport, the named hospital, the specialty, and that the surgery date falls within the validity dates.
  • Cross-check the registration on the official government service channel where the local authority publishes one.
  • Insist on dual signatures: the foreign surgeon's own handwritten signature and the Chinese registered responsible physician's. The consent form should state that the named foreign surgeon performs the key steps. Records in a foreign language need a stamped Chinese translation filed with the original.
  • After surgery, within 24 to 48 hours, review the operative record, ask for copies with the record seal, and if anything goes wrong, ask the hospital to seal the original chart.
