Medical powers of attorney for Chinese hospitals

See how overseas patients can prepare a medical power of attorney for use in China, when notarization or an Apostille may be needed, and what hospitals decide.

Records·

A relative abroad can authorize someone in China, but there is no single document that every hospital must accept. Start with the hospital: ask for its form, the exact powers it will recognize, identity documents, language and authentication route.

Nationality changes the route

China’s overseas remote video-notarization service is for eligible mainland Chinese citizens who live long-term in a participating location. The applicant goes to a designated embassy, consulate or visa-centre site; it is not an at-home video call. The Chinese notarial institution still decides whether it can handle the matter.

A foreign citizen normally uses a local notary in the country of residence, followed by an Apostille if the country is in the Hague system for China, or consular legalization if it is not. An Apostille authenticates the signature or seal; it does not validate every clause or force a hospital to accept it.

Write powers one by one

  • collect specified medical-record copies;
  • receive bills and settle or query named charges;
  • communicate with named departments;
  • submit or collect listed administrative documents;
  • sign only the particular consent that the hospital confirms may be delegated.

Identify principal and agent, scope, duration, whether substitution is allowed, signature and date. A broad phrase such as “all medical decisions” may fail review and should not be treated as authority to sign every operation.

Capacity and emergency care remain separate

If the patient has capacity, the patient makes the decision. If capacity is lost, the hospital must verify the applicable guardian or legal representative and the specific consent. Emergency treatment has its own institutional rules; remote notarization is not a prerequisite for rescue.
